Terms of Service

1. Acceptance of Terms

By accessing or using StreamTranslate ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

StreamTranslate provides real-time translated subtitles for live streamers. The service processes audio from your stream and delivers translated captions as a browser source overlay compatible with OBS, Streamlabs, and similar broadcasting software.

3. Account & Eligibility

• You must be at least 13 years old to use the Service.
• You are responsible for maintaining the security of your account credentials.
• One free trial per person. Creating multiple accounts to circumvent trial limits is prohibited.

4. Payments & Refunds

Subscriptions are billed monthly or as a one-time pass. All payments are processed by Stripe. Monthly subscriptions automatically renew at the end of each billing period and your payment method is charged the then-current rate until you cancel. Starter, Pro, and Captions plans include a monthly hour allowance; if you stream beyond that allowance, overage is billed at the rate shown for your plan and added to your next Stripe invoice at the end of the current billing period. You may cancel at any time from your account or by contacting us; cancellation stops future renewals, and access continues until the end of the current paid period. Subscription charges are non-refundable except where required by applicable law.

5. Acceptable Use

You agree not to use StreamTranslate to:

• Transmit illegal, harmful, or offensive content.
• Reverse-engineer, copy, or resell any part of the Service.
• Attempt to overload or disrupt the Service infrastructure.
• Violate any applicable laws or regulations.

6. Intellectual Property

All content, code, and technology comprising StreamTranslate is owned by StreamTranslate and protected by applicable intellectual property laws. You retain all rights to your own stream content.

7. Service Availability

We strive for high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or factors outside our control. We are not liable for any losses resulting from service interruptions.

8. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind. We do not warrant that translations will be 100% accurate. Real-time AI translation is inherently imperfect and should not be used for safety-critical applications.

9. Limitation of Liability

To the fullest extent permitted by law, StreamTranslate shall not be liable for any indirect, incidental, special, punitive, or consequential damages arising from your use of the Service. Our total aggregate liability for any claim arising out of or relating to the Service shall not exceed the greater of (a) the total amount you paid us in the twelve (12) months preceding the event giving rise to the claim, or (b) USD $100. Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.

10. Indemnification

You agree to defend, indemnify, and hold harmless StreamTranslate and its operators from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) the content you transmit, stream, translate, or display using the Service; (c) your violation of these Terms; or (d) your violation of any law or the rights of any third party.

11. Governing Law

These Terms and any dispute arising out of or relating to them or the Service are governed by the laws of the State of Illinois, United States, without regard to its conflict-of-laws principles. Subject to the arbitration provision below, you agree to the exclusive jurisdiction of the state and federal courts located in Illinois for any matter not subject to arbitration.

12. Dispute Resolution & Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding individual arbitration, rather than in court, except that you may bring claims in small-claims court if they qualify. Arbitration shall be conducted on an individual basis only.

Class Action Waiver: You and StreamTranslate agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. You waive any right to a jury trial.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if you violate these Terms, misuse the Service, fail to pay, or engage in conduct that may harm the Service, other users, or third parties. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (including Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, Governing Law, and Dispute Resolution) will survive.

14. Severability & Entire Agreement

If any provision of these Terms is found to be unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and StreamTranslate regarding the Service and supersede any prior agreements. Our failure to enforce any provision is not a waiver of that provision.

15. Changes to Terms

We may update these terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the updated terms.
